  1. została ona opublikowana po raz pierwszy poza granicami Stanów Zjednoczonych Ameryki (i nie została opublikowana w Stanach Zjednoczonych w ciągu 30 dni od daty jej pierwotnej publikacji);
  2. została po raz pierwszy opublikowana przed 1 marca 1989 roku bez zastrzeżenia praw autorskich, lub przed 1964 bez przedłużenia praw autorskich, lub przed nawiązaniem stosunków prawnych w zakresie prawa autorskiego między krajem ojczystym a Stanami Zjednoczonymi,
  3. nie podlegała ochronie prawnoautorskiej w kraju ojczystym w dniu przywrócenia praw autorskich zgodnie z ustawą URAA (1 stycznia 1996 w większości krajów).
